There are few things more anxiety provoking than the thought of dying suddenly in an accident, and no longer being there to bring up your children. This anxiety can be greatly reduced by preparing a detailed guardianship plan that carefully spells out your wishes. In the event of your tragic demise or incapacity, a Judge will need to approve your plan, so having a well thought out, carefully drafted plan will help ensure the Judge’s consent. Many attorneys simply prepare the legal documents that would be submitted to the court, but choosing an attorney that pays attention to the many details that help smooth a transition, is the best way to achieve peace of mind.
Choosing The Right Guardian
Every guardianship attorney will have you select a guardian, but the most experienced guardianship attorneys know that it’s a good idea to include both a short term and long term choice. For example, the child’s grandparents might be a great choice as short term guardians, but lack the energy for caring for the children long term. A sibling or even a friend might be a better long term choice. These are important considerations when deciding who to select as a guardian. There are many more considerations that you should think about as well. You can use my free guide to help you get started.
Keep in mind when you are preparing the plan it’s crucial to speak to the people you are considering appointing, making sure that they are truly onboard with taking on this responsibility.
